You understand that by participating in the e-Tail West, Palm Springs Event (“Event”) you are accepting these terms and conditions (“Terms”) and agreeing to be bound by them. This Event is organized and administered by WizRocket Inc. (“CleverTap”).
Attendees who request and successfully complete a meeting with CleverTap at the Event are eligible to receive a guaranteed $100 Amazon Gift Card, subject to these Terms.
A. EligibilityAttendees shall register themselves by providing their name, company name, and registered work email address, and by completing a meeting with CleverTap at Booth 616 during the Event.
C. PrizeAll attendees who successfully complete a meeting with CleverTap at Booth 616 during the Event shall be entitled to receive a $100 Amazon Gift Card.
D. Decision MakingCleverTap’s decisions regarding the Event are final and binding. By accepting the gift card, the attendee agrees to release CleverTap, its affiliates, and representatives (collectively, the “Representatives”) from any claims or liabilities arising from participation in the Event or the use or misuse of the prize.
E. Data ProtectionExcept where prohibited by law, participation in the Event constitutes the entrant’s consent to CleverTap and its agents using their personal details shared with CleverTap for promotional purposes without any consideration. CleverTap shall use all personal information in accordance with its privacy policy available at Privacy Policy
F. General ConditionsCleverTap reserves the right, in its sole discretion, to cancel, suspend, and/or modify the Event or any part thereof if it determines that fraud, technical failure, or any other factor beyond its reasonable control has affected the integrity or proper administration of the Event.
Any attempt by any person to deliberately damage, undermine, or interfere with the legitimate operation of the Event may constitute a violation of civil and/or criminal laws. CleverTap reserves the right to seek damages and other remedies to the fullest extent permitted by law. Failure to enforce any provision of these Terms shall not constitute a waiver of such provision.
G. Limitation of LiabilityThe Representatives are not liable for: (1) any incorrect or inaccurate information; (2) unauthorized human intervention in any part of the Event process; (3) technical or human errors in administration or processing; (4) any injury or damage to persons or property arising from participation in the Event or use or misuse of any prize; or (5) any error or fault outside CleverTap’s reasonable control. If an entry is lost or corrupted, the entrant’s sole remedy is participation in the Event again, where applicable.
H. Governing Law and DisputesThese Terms shall be governed by the laws of the State of California and the United States, without regard to conflicts of law principles and excluding the United Nations Convention on the International Sale of Goods. All disputes shall be resolved exclusively in state or federal courts located in Santa Clara County, California, USA. Under no circumstances shall attorney’s fees be recoverable, and no claims for indirect, punitive, incidental, or consequential damages shall be permitted.
